Something To Chew On

I receive a lot of suggestions for columns and recently one came from Sean Glynn of Credant Technologies http://www.credant.com/. Credant specializes in encrypting data on all manner of devices and he sent me an article called "Could your mobile device land your CEO in court?"
The gist of the article was that with all the data we're carrying around on our laptops, smartphones and all manner of other devices we are incurring a huge amount of liability for that data if it falls into the wrong hands. More pointedly the article says that liability goes all the way up to our boss or the CEO of the company.
To amplify this point Sean mentions a Massachusetts regulation 201 CMR 17.00: Standards for the Protection of Personal Information of Residents of the Commonwealth states in 17.03: "Every person that owns, licenses, stores or maintains personal information about a resident of the Commonwealth shall develop, implement, maintain and monitor a comprehensive, written information security program applicable to any records containing such personal information"
He further states, "As defined a "Person," is a natural person, corporation, association, partnership or other legal entity, other than an agency, executive office, department, board, commission, bureau, division or authority of the Commonwealth." In other words this "person" could be the business owner or a company executive. Quite simply, there is no way around this, the company is liable.
So, if you're carrying around a lot of sensitive stuff you'd better start looking at how to encrypt that information or you could have a serious problem. Credant Technologies make a lot of good solutions but they're definitely not the only company that does so look around and come up with a plan.
